INDUSTRIAL AND COMMERCIAL REGISTRATION MAY BE COM-BINED

The MOEA is considering extending throughout Taiwan the model used in the Hsinchu Sci-ence-Based Industrial Park for approving and issuing business registration certificates, which is the combined factory and profit-seeking en-terprise registration certificates. In other words, industrial and commercial registration would be combined into a single system. As well as sim-plifying related administrative procedures, being more convenient for users, and relaxing controls, this would also remove an obstacle to investment and factory construction, and boost investors' confidence.

In view of the recent major changes to the Company Law and Commercial Registration Law and the relaxation of the previous regime, the MOEA is also considering amending the Factory Management and Guidance Law, in or-der to gradually move to a system that places equal emphasis on regulation and guidance, and to relax some outdated controls in line with amendments to other laws. This should make the legislation more appropriate to current needs, and thereby facilitate economic development.

If a system of combined industrial and commer-cial registration is adopted, in the future the reg-istration of business entities will no longer re-quire the examination and approval of land use in accordance with zoning regulations. Therefore, once registration of a factory has been completed, matters such as environmental protection and the regulation of land and building use will be re-turned to the control of the competent authorities under the various laws involved.
