REGULATIONS ON GROUND RECEPTION OF FOREIGN SAT-ELLITE TV CHANNELS

On 4 December 2003 the PRC's State Admini-stration of Radio, Film and Television (SARFT) issued its Regulations Governing the Ground Reception of Foreign Satellite TV Channels, which took effect on 10 January 2004. The regulations introduce a review and approval system for the reception of foreign satellite TV channels, to be administrated by SARFT. Once approval is granted by SARFT, a foreign satellite TV channel may be received at three-star hotels and above that are open to foreign visitors, residential and office buildings for the exclusive use of foreign nationals, and other designated areas.

A foreign satellite TV channel for which recep-tion rights are sought must also meet the fol-lowing conditions:

  • The broadcast content does not violate PRC laws, regulations, or administrative rules;


  • The media organization concerned is lawfully constituted in its home country or territory, has the overall capability for reciprocal coop-eration with PRC broadcasters, and under-takes to actiely facilitate the overseas recep-tion of PRC radio and TV programs;


  • The TV channel, and the organizations di-rectly associated with it, are friendly to the PRC, and have established long-term friendly broadcasting exchange and cooperation rela-tions with the PRC;


  • The channel operator agrees to target its pro-gram transmissions only to the organization designated by SARFT, and not to transmit them into the PRC by any other means; and


  • The channel operator agrees to appoint the designated organization as its sole agent for all matters concerning the reception of its pro-grams in the PRC.
