NEW TRADEMARK OFFICIAL FEES ANNOUNCED
The new Trademark Act, which took effect on 28 November 2003, introduced various new sys-tems, such as multiple-classes trademark appli-cations, divisional applications, and the new re-quirements for the payment of registration fees. To take account of these changes, and in con-sideration of the equivalent fees charged in major countries worldwide, on 26 November 2003 the Intellectual Property Office announced amend-ments to the Regulations of Official Trademark Fees, with effect from 28 November 2003. The main points are as follows:
The basic fees to the applicant for acquiring a trademark registration valid for 10 years are in-creased by 38%, and those for collective marks and certification marks by 88%.
Fees for divisional applications are based on the number of additional applications after division. An additional fee of NT$2,000 is payable if a divisional application is filed while the outcome of an opposition, invalidation, or revocation ac-tion is pending.
The fee for filing an opposition action is in-creased by 60%, and those for filing invalidation and revocation actions by 40%. The fees for amendments to an application or registration, and for issuing various certificates, are reduced by 17%.
