PRELIMINARY ASSESSMENT OF POLLUTION CONTROL SITES
The Environmental Protection Administration recently published a draft of proposed amend-ments to the Regulations for the Preliminary Assessment of Soil and Groundwater Pollution Control Sites. The main points are as follows:
Additional criteria will be introduced for judging whether a soil and groundwater pol-lution control site should be declared a reme-diation site, based on the site's characteristics. If a control site is located in a reservoir water catchment area, national park, wildlife refuge, sensitive ecological conservation zone, the habitat of rare or endangered flora or fauna, a designated scenic area, forest recreation area, educational institution, park, green area, or children's recreation ground, the local envi-ronmental authority should report to the EPA for review and approval before declaring the site a remediation site. A control site for which the EPA has announced major pollution may be declared a remediation site.
Before a control site has been declared a remediation site, the polluter or a related party of the polluted land may submit to the local environmental authority the results of a health risk assessment for the site, and request the authority to review whether it is necessary for the site to be declared a remediation site.
The present provision allowing the EPA to review the preliminary assessment for a con-trol site every two years is to be deleted.
