RULES ON PATENT INFRINGE-MENT ASSESSMENT
In the amended Patent Act promulgated on 6 February 2003 and taking effect on 1 July 2004, the wording of the old Act whereby "the Judicial Yuan and the Executive Yuan shall consult to-gether and designate specialist infringement as-sessment institutes", has been amended to read: "the Judicial Yuan may designate specialist patent infringement assessment bodies." On 29 June 2004, the Judicial Yuan sent to all high courts and administrative courts a list of 55 spe-cialist organizations that are suitable and willing to act as patent infringement assessment insti-tutes, for the reference of courts at all levels.
For guidance in preparing patent infringement assessment reports, the Intellectual Property Of-fice (IPO) has drafted proposed Rules for the Assessment of Patent Infringement, which it sent to the Judicial Yuan for reference on 5 October 2004. Because the IPO's draft Rules are helpful for raising the quality of patent infringement assessment institutes' work, on 2 November 2004 the Judicial Yuan sent the draft to relevant courts and judges for their reference when obtaining infringement assessments.
