JUDGMENT IN OVERTIME PAY-MENT DISPUTES
In a recent judgment, the Shihlin District Court held that in a case where an employer had uni-laterally decided, without convening a la-bor-management meeting, that skilled workers had to work overtime according to a rota, and that overtime pay would be paid at only NT$45 per hour, the workers concerned were entitled to claim the difference, compared with reasonable overtime payments, for the preceding five years. This significant judgment is likely to affect em-ployers' determination of the content of overtime work duty for their workers and the calculation of overtime pay.
