CHANGE OF MEMBERS IN JOINT TENDER CONSORTIUMS
In a letter dated 15 August 2006, the Public Construction Commission indicated that ac-cording to Subparagraph 6 Paragraph 1, Article 10 of the Regulations for Joint Tendering, where a group of suppliers has been awarded a contract under a joint tender, composition of the group may be changed during the performance of the contract only in the case of bankruptcy of a member or other serious circumstances. If a change of member would have affected the original selection of the most advantageous tender, it is inappropriate for the procuring agency to agree to a change of membership un-der Article 11 of the Regulations for Joint Ten-dering.
