COMPANY EXECUTIVES ELIGI-BLE FOR VOLUNTARY LABOR INSURANCE BUT NOT EM-PLOYMENT INSURANCE
In a recent interpretation, the Council of Labor Affairs ("CLA") stressed that only employed persons are eligible to join the Employment In-surance scheme. The responsible officers of a company are not its employees, and therefore are not eligible to join the Employment Insurance in order to receive unemployment benefits under the scheme.
However, a responsible officer of a company may voluntarily enroll in the Labor Insurance as an employer. Under the Labor Insurance Act, years of enrollment as a company officer or as an employee can be added together, and both count equally toward entitlement to old age benefits.
