IMPERMISSIBLE GROUNDS FOR REJECTING TENDERS
In an interpretation dated 8 May 2007, the Public Construction Commission (PCC) stated that an invitation to tender issued by a procuring agency may not stipulate that tender documents sub-mitted by a supplier will be rejected as disquali-fied tender for any of following reasons:
.Failure to apply a company stamp across the envelope flaps and seams.
.Failure to stamp every page of the tender documents.
.Failure to include a payment receipt for online collection of tender documentation.
.The layout, font size, binding method, or number of copies of the tender documents is not as that prescribed in the invitation to ten-der.
The PCC further stated that if an invitation to tender does include such grounds for rejection, such provisions are ineffective.
