NO DISCRIMINATION OVER AGE, ORIGIN OR SEXUAL ORIENTA-TION



Recent amendments to the Employment Services Act (ESA) added age, place of birth, and sexual orientation to the items covered by the ban on discrimination with regard to equality in access to employment. The amendments took effect at the end of May 2007. In future, employers that set age limits in recruitment advertisements that are found to be in violation of the law will be liable to administrative fines ranging from NT$300,000 to NT$1.5 million.

The amended Article 5 of the ESA prohibits employers from subjecting persons seeking em-ployment, or existing employees, to disadvan-tageous treatment based on any of the following 16 grounds for discrimination: ethnicity, class, language, ideology, religion, political affiliation, place of ancestral origin, place of birth, gender, sexual orientation, age, marital status, appear-ance, facial features, physical or mental disabil-ity, or history of union membership.
