DESIGNATION OF SPECIAL INDUSTRIES AND PERSONNEL UNDER THE LABOR STANDARDS LAW

The Council of Labor Affairs (CLA) has successively designated the management consulting industry, bill finance industry, food and beverage industry, entertainment industry, national defense industry, and credit card processing industry as special industries under Article 30-1 of the Labor Standards Law (LSL). Those industries are thereby exempt from the restrictions under Paragraph 2, Article 30, Article 36, and Article 49 of the LSL concerning regular working hours, holidays, and nighttime work by female workers. The CLA also approved and announced the international trade industry, credit guarantee funds, the entertainment industry, the film projection industry, and the credit card processing industry as special industries under Paragraph 2, Article 32 of the LSL, thereby exempting those industries from the restrictions on extended work hours stipulated in Paragraph 1 of the same Article.

The CLA has also successively announced the personnel listed below as personnel referred to in Article 84-1 of the LSL. In the case of such personnel, matters such as work hours, holidays and vacations, and nighttime work by female workers may be decided by a written agreement between the workers and the employer, to be submitted for approval by the local authority-in-charge, whereupon the relevant restrictions of the LSL cease to apply;

Certain personnel in certain medical and health care service institutions (including armed forces hospitals and their attached public clinics).

Aides of the governors of the Central Bank of China.

Technicians and workers in the offices of the president and vice president of the Legislative Yuan.

Technicians and workers of the Ministry of Foreign Affairs involved in receiving foreign guests.

Site technicians and workers of the Ministry of Examination.

Coroner's car drivers of the Ministry of Justice.

Architectural firm personnel as follows: project managers, architectural planning and design personnel, and on-site construction supervisors.

Personnel at the manager level or higher employed by credit cooperatives and conforming to the provisions of Article 50-1-1 of the LSL Enforcement Rules.

Professional photographic technicians and news coverage car drivers employed by the Taipei City Government's Department of Information to accompany the mayor on travels.

Pumping station operators employed by the Maintenance Engineering Department, Taipei City Government's Bureau of Public Works.

Civilian security personnel employed by the Ministry of National Defense.
