EMPLOYERS SHOULD SEEK EMPLOYEES' CONSENT TO WORK DURING UNPAID LEAVE AND PAY THE EMPLOYEE DAILY SALARY
According to a ruling issued by the CLA, when an employer has obtained an employee's consent to take unpaid leave but needs the employee to work during the period of unpaid leave, the employer should seek the employee's consent again and pay the employee daily salary after securing his/her consent. Further, if the employee is required to work overtime during such period, the employer should give the employee overtime pay pursuant to the Labor Standards Act.
