ENFORCEMENT RULES FOR SATELLITE BROADCASTING AND TELEVISION LAW APPROVED

On 10 June 1999, the Government Information Office of Executive Yuan promulgated the Enforcement Rules for the Satellite Broadcasting and Television Law. The Enforcement Rules have 16 articles, and the key contents are as follows:

The minimum paid-in capital for satellite television broadcasters, is NT$200 million for operators of direct satellite television broadcast services and NT$50 million for satellite television program suppliers. The paid-in capital requirement for a company operating both types of businesses is NT$200 million.

The minimum operating capital and minimum paid-in capital shall be NT$20 million for branch companies or representative offices of foreign satellite television broadcasters who apply to be direct satellite television broadcasters or satellite broadcast program providers in Taiwan. Likewise, the minimum capital requirement to operate both a branch office and a representative office is NT$20 million.

Foreign satellite television broadcasters must submit applications for operation upon establishing branch companies or representatives offices in Taiwan. Representative offices representing two or more channels of foreign satellite television broadcasters must submit separate permit applications with the competent authority.

Satellite television broadcasters and foreign television broadcasters, as well as parties wishing to change licenses, must submit a business plan and an application form to the competent authority. The competent authority will make a decision to grant or reject the application within three months of receiving the documents.
