AMENDMENT TO THE COPYRIGHT ACT REGARDING FAIR USE BY PERSONS WITH VISUAL AND HEARING IMPAIRMENT



On 5 January 2010, the Legislative Yuan passed the amendment to Article 53 of the Copyright Act regarding fair use by persons with visual and hearing impairment, under which the article will apply to persons who have learning difficulties or visual or hearing impairment. The amendment enlarges the scope of fair use to suit the needs of persons with visual or hearing impairment and improve the protection of the rights and interests of physically and mentally disabled persons. The amendment is as follows:

Any publicly published works may be reproduced by using Braille, sign-language interpretation or words for persons who have visual, learning or hearing functional impairment or otherwise visually or audially impaired.

To improve the welfare of persons with visual, learning or hearing functional impairment or otherwise visually or audially impaired, any non-profit organizations or groups which are organized under the law may utilize any published works by means of recording, computers, oral description of video images, sign-language interpretation or other means for exclusive use by persons with visual, learning or hearing functional impairment or otherwise visually or audially impaired.
