PUBLIC NOTICE OF THE REGULATIONS GOVERNING FIXED NETWORK TELECOMMUNICATIONS BUSINESSES
On 18 May 1999, the Directorate General of Telecommunications (DGT), the Ministry of Transportation and Communications (MOTC) officially announced the Regulations Governing Fixed Network Business. The contents of the draft regulations were reported in the January 1999 issue of the Lee and Li Bulletin. The official regulations differ from the draft in two principal respects -applications and obtaining licenses - as outlined below:
Capital Injection Timetable: Article 8-1 provides that the minimum paid-in capital for operators of full-service networks shall be NT$40 billion. Article 8-2 provides that applicants must raise NT$10 billion upon submitting applications and raise another NT$10 billion within 60 days of approval. The remaining capital should be paid in within six months of the date of the MOTC Establishment Approval.
Network Construction Requirement for Issuance of Special Permit: Article 23 provides that an applicant must construct a local network with a system capacity of 150,000 subscribers' numbers, subscribers' ports or a combination of both. After the DGT has reviewed an applicant's qualifications, the applicant may apply for the special permit for commencement of operations.
