GOVERNMENT MAY INTERVENE IN PRIVATE EMPLOYMENT RE-LATIONSHIPS
In a judgment dated 14 April 2000, the Admin-istrative Court held that although the em-ployer-employee relationship is a private-law relationship, government agencies with respon-sibility for labor affairs, acting in accordance with their statutory powers and duties, do indeed have the right to make determinations as to per-tinent facts and circumstances when examining whether an employer has acted lawfully in exer-cising its right to terminate a contract of em-ployment. The argument of the employer in question that government agencies are not enti-tled to directly interfere in private contractual relationships, and that in the case of a dispute recourse should be made to courts, was not found to be persuasive.
Accordingly, the court upheld the administrative fine imposed on the appellant for illegal termi-nation of an employment contract.
