COPYRIGHT IN AUTHORIZED TRANSLATIONS OF FOREIGN WORKS
In a recent criminal judgment in a copyright in-fringement case, the Supreme Court stated that an original work and its derivative work in the form of an authorized translation are two inde-pendent works. Where an ROC citizen obtains authorization to translate in the ROC the work of a foreign national, the derivative work created by such translation is an independent work of the ROC national, and enjoys copyright protection upon its creation under Article 10 of the Copy-right Law. Such copyright is acquired originally, not derivatively, and is not subject to the provi-sions concerning the acquisition of copyright by foreign nationals.
