Amendment of ROC (Taiwan) Patent Law Promulgated and Announced
Dear Sirs,
For purposes of enhancing the economic and industrial competitiveness, promoting development of local critical technologies, as well as to comply the need of enhancing the quality of patent examination, the Legislative Yuan of the ROC (Taiwan) completed the 3rd reading of an amendment of the Patent Act ("Amended Act") on 29 November 2011 and the amended provisions were promulgated by the President on 21 December 2011. According to Article 159 of the Amended Act, the date on which the amended provisions take effect shall be decided and announced by the Executive Yuan. It is expected that the Amended Act will take effect in around November 2012. We have prepared an English translation of the Amended Act (Attachment 1) as well as a memorandum regarding the major amendments (Attachment 2) and enclose the same for our clients' reference.
Considering the broad range of amendments, the Intellectual Property Office has started amendments of the Enforcement Rules, Patent Examination Guidelines, and their internal patent examination management systems so as to adapt to the Amended Act. Since October 2003, our firm and Lee and Li-Leaven IPR Agency Ltd. in Beijing (our IP alliance firm in China) formed alliance and jointly serve our clients' IP interests through our Greater China IP Services which has been highly appreciated and recognized by our clients. In November 2011, China, for the first time, started to allow all Taiwanese to take patent attorney bar examination in China. Several colleagues from Lee and Li have passed the examination. All these efforts will ensure a more successful trend of our Greater China IP Services. Comments and suggestions from clients are always critical for us to continue to perform better.
