Taiwan's New Patent Act Will Take Effect on 1 January 2013

Taiwan's Legislative Yuan completed the third reading of the amendment bill of the Patent Act on 29 November 2011 and the amended Patent Act provisions were promulgated by the President on 21 December 2011. The amended Patent Act will take effect on 1 January 2013. With respect to the major contents of the amended Patent Act, please refer to Lee and Li's Alert Sheet dated 2 January 2012 (see Attachment 1). To cope with the implementation of the amended Patent Act, the Intellectual Property Office ("IPO") and its supervising agencies have worked on amendments to the Enforcement Rules of the Patent Act, and have also amended the relevant Patent Examination Guidelines, the Regulations Governing Patent Official Fees, and other patent regulations. We have prepared the attached memorandum regarding the major amendments (see Attachment 2) for your reference. If you have any questions or need our assistance, please do not hesitate to contact us.

In addition to the continuous growth of all legal practice areas for Taiwan, Lee and Li, since October 2003, have formed an alliance with Lee and Li-Leaven IPR Agency Ltd in Beijing, (our IP alliance firm in China) and Leaven, Attorneys-at-Law in Shanghai, respectively, to jointly provide Greater China Legal Services. In light of the high service quality and integrated efficiency, our Greater China Legal Services have rapidly progressed and received high acknowledgement from our clients. Ever since China started to allow all Taiwanese to take attorney-at-law and patent attorney bar examinations in China several years ago, numerous colleagues from Lee and Li are passing both examinations annually. This continuous expansion of professional resources across the Taiwan Straight can certainly assure the best choice for our clients who use our Greater China Legal Services. Comments and suggestions from clients are always vital for us to continue to perform better. As always, we welcome your input, comments and/or suggestions.
