Amendments to the Regulations of Trademark Fees



We wish to inform you that the Regulations of Trademark Fees were amended and promulgated on December 27, 2010 by the Taiwan Ministry of Economic Affairs. The amendments will take effect as of February 1, 2011. The amendments make adjustments in the official filing fees of new trademark/collective mark applications and add a refund request clause for renewal applications. We hereby summarize below the amendments:
I. Official Fee for New Trademark & Collective Mark Application
Before January 31, 2011
The official filing fee is calculated based on the number of the designated goods or the number of service classes as follows:
1 to 20 Items of Goods in One Class NT$3,000 (approx. US$111)
21 to 60 Items of Goods in One Class NT$5,000 (approx. US$185)
61 Items of Goods and up in One Class NT$9,000 (approx. US$333)
Services in One Class NT$3,000 (approx. US$111)
As of February 1, 2011
The official filing fee is calculated based on the number of the designated goods or the designated services as follows:
Goods in One Class
(Class 1~Class 34)
NT$3,000 (approx. US$111) for 1 to 20 items of goods
*If the designated goods per class are over 20 items, an official fee of NT$200 (approx. US$7.4) will be charged for each additional item.
Services in One Class
(Class 35~Class 45)
NT$3,000 (approx. US$111) per class
*If the retail services of specific goods in Class 35 are over 5 items, an official fee of NT$500 (approx. US$19) will be charged for each additional item.
II. Official Fee for Trademark Renewal
The official fee of NT$4,000 (approx. US$148) for a renewal application is not changed. The amendments, however, stipulate that the applicant may request for a refund of the official fee when a renewal application has been withdrawn before the notification of approval is made.
